Magic Circle Terms and Conditions

Welcome to the Magic Circle Print Rewards program (“The Magic Circle”). The Magic Circle is organized by PrintMagic.com (“PrintMagic”, “we” or “us”) and these Terms and Conditions (the “Terms”) govern your participation in the Magic Circle. Please read these Terms carefully. By participating in the Magic Circle, you agree to be bound by these Terms.

Eligibility

To participate in the Magic Circle, you must be at least 16 years old and a legal resident of the United States. Employees of PrintMagic, its affiliates and subsidiaries, and their spouses and children are not eligible to participate in the Magic Circle. We reserve the right to revoke loyalty membership for any reason. By enrolling and participating in the Magic Circle, you represent that you meet these eligibility requirements.

Joining The Magic Circle

If you meet the eligibility criteria above, you can join the Magic Circle by filling out a registration form on PrintMagic.com, or through the PrintMagic mobile site. No purchase is required to enroll in the Magic Circle. Only one account is allowed per individual with a valid email address. Creation of multiple accounts can be grounds for removal from the program and forfeiture of any Points in those accounts. A member must create an online account on PrintMagic.com on a desktop or mobile device to complete registration, earn and access Points, and begin using membership rewards and benefits. If a member has not accessed their account within 12 months after enrollment, the member’s existing loyalty Points will be forfeited and removed from the member balance.

Earning Points

Members of Magic Circle will earn Points “Magic Circle Points” for purchases that are made on PrintMagic.com, via desktop or mobile device. Points are awarded after rewards redemption, site or product discounts, coupons or any other price reduction. Items that are ineligible for Points earn include gift card purchases, taxes and shipping & handling, setup charges, run charges, surcharges, mailing postage, and mail service fees. Earned Points are considered pending until associated orders(s) ship, at which time they will post to the member account and can be used on subsequent orders. Points redeemed on orders will be deducted from available Point balance at the time order is placed and will be pending until the order(s) ship at which point they will be fully deducted from the member’s Point balance.

Redeeming Points

Earned and posted Points can be redeemed on the payment page of the checkout process. You can choose to redeem all or a selected number of Points (not to exceed the amount of the order print sub-total). Points provide a discount of $.10 (ten cents) for each Point redeemed. The discount amount is applicable to only to printing, promotional product prices and design services and custom orders. Points redeemed are not applied to gift card purchases, taxes and shipping & handling, setup charges, run charges, surcharges, mailing postage, and mail service fees. Redeemed Point discount value is applied after any and all other discounts. Partial Points cannot be used and the needed amount will be rounded up to the nearest whole Point. Points redeemed are deducted from available Points balance as a pending transaction and will post to the member’s final balance when the order ships. In case of adjustments and refunds on prior orders where points were redeemed for purchase, any balance due after application of Points will be collected from the member by another payment method. For orders with multiple items, Points will be redeemed and applied to multiple items, starting with the most expensive item and applied to subsequent items until Points are exhausted or Points have covered all items in the order. For equal value items Points will be applied in the order in which they are added to the cart. Members cannot select which items to apply Points in a cart, as this will be done automatically as detailed above.

Tier Bonus

At Level 2 and above members earn a percentage bonus to base Point awards, as detailed in the tier benefits section in this document. We reserve the right, at our discretion, to retroactively credit or not award Points for sales where the member was not logged in or did not provide membership information.

Expiration of Points

All Points earned by members are valid for three hundred sixty-five (365) days from the date of the last active purchase placed under the member’s account. Points are not transferrable between members. Points have no cash value and cannot be exchanged for cash. Points from different accounts cannot be combined for redemption.

Refunds and Credits

Credits and Refunds made prior to the item shipping: Points earned for a credit or refund will not be earned and not posted to the member total balance of Points. Points redeemed for an order credited or refunded will be returned to the member’s Point balance for the refunded portion of the order or item. Refunds and credits to these orders will first be returned as Points and then as cash depending in the value of the order and amount refunded. Points will never be credited as cash or other payment method. Credits and Refunds made AFTER to the item shipping: The redemption value of Points earned for a credit or refund will be deducted from the total refund amount at a value of $.10 (ten cents) per Point awarded on cancelled or refunded order. Points redeemed for an order credited or refunded will be returned to the member’s Point balance for the refunded portion paid by Points. The remaining credit due will be returned as cash, less the value of any Points earned but not able to be deducted from member balance on that order, as explained above for shipped orders where Points were awarded.

Program Tier Progression

Magic Circle has four (4) tiers. Members can progress through these tiers by the amount they spend on eligible items on PrintMagic.com in a 12-month calendar period. Circle Level 1 (Level 1) tier is the entry-level tier. Members only need to register for Magic Circle to be a part of this tier. No purchase is required. Members can progress to Level 2, Level 3 and Inner Circle tiers by spending the required dollar amount within the calendar year (January 1st -December 31st). When moving up Tiers, a member will receive that Tier status for the remainder of the current calendar year plus the subsequent full calendar year. Tier status will be obtained as soon as qualified spend is met and the associated orders are shipped. When account is deactivated due to no purchase activity over a 24-month period, the Tier level is lost along with any point balance.

Tier Level Re-Qualification (Level 2, Level 3 and Inner Circle Members)

On the member’s evaluation date January 1) We will evaluate a member’s cumulative spend in the previous calendar year to determine whether they are eligible to retain their level status. Example: Member has qualified for Tier 2 on February 15th, 2024. They will maintain this tier level until the evaluation date of January 1st, 2026. At that time their 12-month annual spend for year 2025 will determine if their tier level will be maintained or adjusted to the earned 12-month level Tier downgrades could happen in the following ways: If a customer does not accumulate enough spend to retain their current tier status by January 1st of their evaluation date, then they will be adjusted to the appropriate level. If the member spends enough to earn Level 2, Level 3 or Inner Circle status in the current calendar year and then returns an order/product which brings their total spend in the current calendar year below the thresholds to earn that tier status, then their status will change to reflect their new calendar year spend total.

Tier Rewards and Benefits

Entry and progress through each of the above-mentioned tiers will unlock a set of new benefits and rewards for members. Members will have access to the rewards in their current tier and the tiers below them. When a member moves down tiers, they will lose access to benefits from the higher tiers. Magic Circle Level 1 (Level 1): 1 Point earned for every $1 spend on applicable purchases. Points can be redeemed for a $.10 (ten cents) discount for each Point spent on applicable purchase amounts. Magic Circle Level 2 (Level 2): 1 Point earned for every $1 spend on applicable purchases PLUS a bonus of 15% on base Points awarded. Points can be redeemed for a $.10 (ten cents) discount for each Point spent on applicable purchase amounts. Magic Circle Level 3 (Level 3): 1 Point earned for every $1 spend on applicable purchases PLUS a bonus of 25% on base Points awarded. Points can be redeemed for a $.10 (ten cents) discount for each Point spent on applicable purchase amounts. Special perks and awards for Level 3 Members as determined by us. The Inner Circle (Level 4): 1 Point earned for every $1 spend on applicable purchases PLUS a bonus of 50% on base Points awarded. Points can be redeemed for a $.10 (ten cents) discount for each Point spent on applicable purchase amounts. Exclusive perks and awards for our customers, as determined by us. Other benefits not mentioned here may be awarded to members on a surprise and delight basis at the discretion of the company. Specific Rewards and Benefits may be subject to change, discontinuance, limitations, and substitutions by us, at our discretion, and at any time without notice. The total value of rewards applied to a purchase cannot exceed the total cost of the purchase. Awards and Points are not redeemable for cash and void where prohibited, licensed or regulated.

Use of Account

Members are responsible for maintaining the confidentiality of their password and account and are fully responsible for any and all activities that occur under their password or account. Members should immediately inform our customer care of any unauthorized use of their password or account or any other breach of security. Magic Circle is for members’ personal use only. Members agree not to display, distribute, license, perform, publish, reproduce, duplicate, copy, create derivative works from, modify, sell, resell, exploit, transfer or upload for any commercial purposes, any portion of the Magic Circle. The transfer, sale, or barter (or the attempted transfer, sale, or barter) of Points, member exclusive promotional offers, and any misrepresentation of fact relating thereto, may result in cancellation of the member’s account, including any unused Points in our sole discretion.

Privacy and Consent to Marketing

The information you provide as a member of Magic Circle will be managed by us as described in our Privacy Policy. By becoming a member of the Magic Circle, you consent to receive marketing, promotions, special events, and other communications from PrintMagic, its affiliates, and brands. You may unsubscribe from marketing communications at any time. For information on how to do so, please visit our Privacy Policy.

Termination; Expiration; Changes to The Magic Circle

We may cancel your membership at any time for any reason in our sole discretion, including, but not limited to, if we determine that you (a) are ineligible, (b) have not used your account for an extended period of time, (c) violated any term or condition of the Magic Circle or any applicable law or regulation, or (d) engaged in any deception, forgery, fraud or committed any other abuse of the Magic Circle. We may revoke some or all of your Points or rewards if we determine that you received Points or a reward due to an error, through fraud or deception, or in any manner not authorized. We can also at our sole discretion prevent an account from earning points. In all matters relating to the administration of The Magic Circle, the decisions of the company will be final. We reserve the right to change or cancel any aspect of The Magic Circle, at any time. If we change these Terms, we will give you notice by posting the new Terms here. Those changes will go into effect on the Revision Date shown in the revised Terms. By continuing to participate in The Magic Circle, you are agreeing to the revised Terms. All interpretations of The Magic Circle terms and conditions shall be at our sole discretion. Our failure to exercise or enforce any right or provision of these rules shall not constitute a waiver of such right or provision.

OTHER LEGAL CONDITIONS

THE MAGIC CIRCLE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PRINTMAGIC DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, WITH RESPECT TO THE MAGIC CIRCLE (INCLUDING THOSE RELATED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT AND THOSE ARISING OUT OF COURSE OF DEALING, USAGE, OR TRADE). TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING FOR THE LOSS OF PROFIT, REVENUE, OR DATA) ARISING OUT OF OR IN CONNECTION WITH THE MAGIC CIRCLE, HOWEVER CAUSED, AND UNDER WHATEVER CAUSE OF ACTION OR THEORY OF LIABILITY BROUGHT (INCLUDING UNDER ANY CONTRACT, NEGLIGENCE, OR OTHER TORT THEORY OF LIABILITY) EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THESE TERMS AND THE MAGIC CIRCLE ARE GOVERNED BY THE LAWS OF THE STATE OF CALIFORNIA. ANY DISPUTE ARISING FROM THESE TERMS OR IN CONNECTION WITH THE MAGIC CIRCLE SHALL BE RESOLVED BY BINDING ARBITRATION IN THE STATE OF CALIFORNIA. BY AGREEING TO BINDING ARBITRATION, EACH PARTY UNDERSTANDS THAT THEY EACH FOREVER GIVE UP AND WAIVE ANY RIGHT WHICH EACH PARTY MAY HAVE TO RESOLVE ANY SUCH DISPUTE BY COURT OR JURY TRIAL. ALL TRADEMARKS, SERVICE MARKS AND TRADE NAMES OF PRINTMAGIC USED IN CONNECTION WITH THE MAGIC CIRCLE (INCLUDING BUT NOT LIMITED TO THE PRINTMAGIC NAME) ARE TRADEMARKS OR REGISTERED TRADEMARKS OF PRINTMAGIC. THEY MAY NOT BE USED WITHOUT PRINTMAGIC’S PRIOR WRITTEN PERMISSION. ANY OTHER INTELLECTUAL PROPERTY USED IN CONNECTION WITH THE MAGIC CIRCLE, INCLUDING BUT NOT LIMITED TO PATENTS, ISSUED OR PENDING, ARE THE SOLE PROPERTY OF PRINTMAGIC AND/OR ITS LICENSORS. THE ENTIRE CONTENT OF THE MAGIC CIRCLE, INCLUDING BUT NOT LIMITED TO TEXT, GRAPHICS, OR CODE IS COPYRIGHTED AS A COLLECTIVE WORK UNDER THE UNITED STATES AND OTHER COPYRIGHT LAWS, AND IS THE PROPERTY OF PRINTMAGIC.
